Welcome to Cinemaya, a mobile application that provides AI-driven video generation services. By accessing or using Cinemaya, you agree to abide by these Terms and Conditions. Please read them carefully before using the app.

1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of Cinemaya ("App") and the services provided through it ("Services"). By creating an account or using our Services, you agree to these Terms. If you do not agree, please do not use the App.

2. Credits System

Cinemaya uses a credits-based system to enable access to its video generation and customization features. The credits system is defined as follows:

Credits per Second of Video Generation: Varies by AI model/provider; each model’s rate is displayed before you generate (e.g., Runway ML Gen 4 Turbo (720p) = 10 credits/sec; Luma Ray 2 (720p) = 15 credits/sec; Kling 1.6 Pro (1080p) = 11 credits/sec; MiniMax Video-01 (1080p) = 9 credits/sec; Wan 2.1 (720p) = 25 credits/sec; Wan 2.1 (480p) = 8 credits/sec; Kling 1.6 Standard (720p) = 6 credits/sec; Google Veo 2 (720p) = 52 credits/sec; etc.).
5 Credits per Image Generation: 5 credits allows you to generate one image using our AI technology.
20 Credits = 1 Custom Element: You can use 20 credits to include a custom element, such as a unique character, style, or object, in your video, if your a paid subscriber. Your first custom element is free.
Monthly Subscription Credits: Monthly subscription plans provide a set number of credits that reset at the start of each billing cycle.

3. Account and Subscription

To access the App, you must create an account. Subscriptions are available for purchasing monthly credits, which reset at the beginning of each billing cycle.

4. Usage Guidelines

When using Cinemaya, you agree to:

Use the App in accordance with applicable laws and regulations.
Refrain from using the App for unlawful or harmful purposes.
Respect the intellectual property rights of Cinemaya and other users.
You are solely liable for the content you generate on the platform. You must not create or generate any content featuring copyrighted brands, persons, objects, or any other copyrighted material without obtaining proper permissions from the respective owners.
Not engage in activities that are unlawful, harmful, or violate the rights of others.
Not distribute, sell, or sublicense the Services to third parties without authorization.
Not reverse engineer, decompile, or disassemble any part of the Services.
Not interfere with the operation of the Services or circumvent access restrictions.
Not transmit viruses or harmful materials.
Not use the Services to harass, threaten, or harm others.
Not collect personal information about others without consent.
Not engage in fraudulent activities, including impersonation or false affiliations.

5. Content Moderation Policies

We have implemented robust content moderation measures to ensure a safe and respectful environment on the platform. Prohibited content includes, but is not limited to:

Sexually explicit or obscene material.
Depictions of violence, gore, or other graphic content.
Hate speech, harassment, or discriminatory content targeting individuals or groups.
Content that promotes illegal activities or misinformation.
Unauthorized use of images, likenesses of public figures, or copyrighted material without appropriate permissions.

Content found in violation of these guidelines may be removed, and repeat offenses could lead to account suspension or termination.

6. Intellectual Property

All content, features, and functionalities of the App, including but not limited to text, graphics, logos, and software, are owned by Cinemaya and are protected by copyright, trademark, and other laws.

By using the App, you grant Cinemaya a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, and distribute the content you generate on the platform for the purpose of operating, improving, and promoting the Services. You represent and warrant that you have all rights necessary to grant this license.

7. Limitation of Liability

Cinemaya is provided on an "as is" and "as available" basis. We do not guarantee that the App will be error-free or uninterrupted. To the fullest extent permitted by law, Cinemaya disclaims all warranties, express or implied.

8. Changes to Terms

We may update these Terms from time to time. If we make significant changes, we will notify you within the App or by other means. Your continued use of the App after changes become effective constitutes acceptance of the new Terms.

9. Account Registration and Security

Users must provide accurate and complete information during registration and keep it updated.
Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.
Users should promptly notify Cinemaya of any unauthorized use of their account or security breaches.

10. Age Requirements

Users must be at least 13 years old to use the Services.
Users under 18 years old must have parental or legal guardian consent to use the Services.

11. Modifications to the Services and Fees

Cinemaya reserves the right to modify or discontinue the Services at any time without prior notice.
Cinemaya may change the fees for the Services and will notify users of any such changes at least thirty (30) days before they apply.

12. Termination and Suspension

Users may terminate their account at any time by following the account termination procedures provided within the App.
Cinemaya reserves the right to suspend or terminate a user's access to the Services for violations of these Terms or other policies.

13. Dispute Resolution

Users agree that disputes arising under these Terms will be resolved by binding, individual arbitration, and waive the right to a trial by jury or to participate in any class action or representative proceeding.

14. Privacy Policy

Cinemaya's collection and use of personal information are governed by its Privacy Policy, which users should review to understand how their data is handled.
